Subscription Terms and Conditions
This document specifies the terms and conditions of use for a subscription to Sociological Research Online ('the Journal'), governing access to and use of the content of the Journal for which the Licensee is purchasing access on an annual subscription basis from the Sociological Research Online Consortium ('the Consortium').
The licence gives staff and students of an institution access to the electronic journal, Sociological Research Online, including both the current issues and all back issues since the first in March 1996. The licence covers the rights granted by the publisher, a consortium of the Universities of Surrey and Stirling, the British Sociological Association and Sage Publications Ltd., to the licensee, usually an institution of higher education. The licence is granted in return for an annual subscription.
The possession of a licence provides free access to students and staff of the institution who access the journal through the Internet from a computer within the institution's internet domain. People accessing the journal from a computer in the institution's domain do not need a username or password and will be able to browse, read and download articles from the Journal. People using computers with addresses outside a licensed domain will be able to read the contents pages and abstracts of articles in the Journal, but will be prevented from accessing the full text.

SECTION 1. RIGHTS AND OBLIGATIONS OF THE LICENSEE
1.1 The Licensee may use and access and allow Authorized Users (as defined in ¶1.2) to use and access the electronic version of the Journal which is available to the Licensee via the Licensee's subscription, provided always that such access and use is via a Network over which the Licensee has sufficient control to limit distribution of the Journal to the Authorized Users. In addition, the Licensee shall take reasonable necessary measures to safeguard the intellectual property and proprietary rights of the Journal and any others involved in the creation of the Journal including the property and moral rights of all contributors to the Journal. All rights in the Journal which are not specifically granted to the Licensee under this Licence are expressly reserved to the Consortium.Explanatory note: An institution acquiring a license will normally already possess a domain name (e.g. anywhere.ac.uk or anywhere.edu) and a corresponding network address (e.g. 123.456.321.xxx). All computers within the institution will have IP addresses which include the institution's network address.
1.2 The following are Authorized Users of the Journal: current (permanent or visiting) members of the academic, library, research or equivalent staff of the Licensee and students actively and currently undertaking a course who are subject to the Licensee's normal terms and conditions for ensuring compliance with the terms of this Licence. Authorized Users must access the Journal through a computer within the licensed Network (as defined in ¶1.5). Physical visitors using public access terminals connected to the Network, who must be made aware of the obligations of Authorized Users shown below (§3) may also use the Journal, although they will not be considered Authorized Users. Remote electronic access to and use of the Journal by people accessing it from networks other than the one(s) licensed is not permitted.
Explanatory note Users who dial-in to an institution's network using a modem (for example, from home) and who are assigned an IP address belonging to the Network by communication software are thereby treated as Authorized Users. Users who dial-in to an Internet Service Provider (and acquire the IP address of the ISP) would not be Authorized Users under the institution's licence (but may be able to get free access to the Journal on their own account).
1.3 The Licensee may not use or permit Authorized Users to use the Journal for the purposes of monetary reward by means of sale, resale, loan, hire, lease or any other form of exploitation. The Licensee may not store or permit Authorized Users to store the Journal on any medium, transfer, reproduce, modify, publish or otherwise exploit the Journal except in so far as is reasonable to exercise the rights granted under this Licence. If the Journal or parts of the Journal are copied for storage or other purposes by the Licensee, the author's name, the article title, journal name, and copyright and other notices or disclaimers must be preserved in the copies. Neither the Licensee nor the Authorized Users may include paper copies of any part or parts of the Journal in coursepacks or other collections for teaching purposes, or make any part of the Journal available for access by way of remote computing services beyond the Network. Notwithstanding these restrictions, Licensees may make copies on paper of individual articles for those who are not Authorized users for them to use for private study.
Explanatory note: The Licensee may copy the Journal to its own server (including a cache or proxy server) provided that the conditions for use of that copy are the same as those which would apply if the Journal was directly accessed.
The Licensee and Authorized Users may include links (URLs) to articles in the Journal in printed course packs, but may not print or photocopy multiple copies of articles for course packs.
Licensees may provide 'inter-library loans' of material from the Journal to other, non-subscribing libraries.
1.4 The Licensee is responsible for all charges associated with accessing the Journal, including any charges levied by the intermediary through whom the electronic subscription is delivered, as well as any computer equipment, software, telecommunication or internet connection charges.
1.5 This Licence covers a single network within the Internet ('the Network') which shall be a set of TCP/IP addresses constituting a Class A, Class B or Class C network. Computers from which Authorized Users can access the Journal must be connected to this Network. If the Licensee wishes the Licence to cover more than one Network it must obtain a consortium licence.
Explanatory note: A Class A network includes addresses all of which have the same first three hex digits (e.g. 123.xxx.yyy.zzz, where xxx, yyy, and zzz differ between different computers connected to the network); a Class B network has addresses which share the same first six hex digits (e.g. 123.456.xxx.yyy), and a Class C network has addresses which share the same first nine hex digits (e.g. 123.456.321.xxx).
1.6 Licensees must promptly notify the Consortium (preferably by email to socres@socresonline.org.uk) of any infringement of copyright in the Journal or unauthorized use of the Journal of which they become aware. In the event of any infringement or unauthorized use, Licensees will take all reasonable steps to prevent a recurrence. Licensees shall not be liable to the Consortium for breach of the terms of this Licence so long as the Licensees did not intentionally assist in or encourage such breach or permit the breach to continue after it has been noticed.
SECTION 2. OBLIGATIONS OF THE SOCIOLOGICAL RESEARCH ONLINE CONSORTIUM
2.1 The Consortium undertakes to provide access to the Licensee during the period for which an electronic subscription was purchased to the Journal which shall comprise the contents published in the Journal by the Licensee and all back issues from the inception of the Journal. No right is hereby created for the Licensee to use or access any material other than that for which an electronic subscription has been purchased from the Consortium pursuant to this Licence.Explanatory note Once an institution has taken out a subscription, it has access to the complete backrun as well as current issues. It may make a copy of the complete backrun for archival purposes on its own hardware. If it terminates the subscription, it may retain a copy of all the issues it has had access to, including all the backrun, provided that this copy is only accessed by Authorized Users within the institution's Network.
2.2 The Consortium warrants that it has the right to license the Journal granted to the Licensee under this Licence. The Consortium does not make any representation or warranty or accept responsibility for the accuracy, currency, or completeness of the content of the Journal. The Consortium reserves the right to withdraw from the Journal any item contained in it or any part of it if the Consortium believes that such item contains any material which may be legally objectionable, on whatever grounds.
SECTION 3. NOTES FOR AUTHORIZED USERS
Explanatory note The Licensee is encouraged to print-out, photocopy or otherwise make available to Authorized Users these notes. They are also available from the Journal itself.The entire contents of Journal (including individual articles and other material appearing in the journals) are protected by copyright. Electronic access to Journal is further governed by the terms of licences which regulate such access. The following notes provide information on some key elements of these licences.
3.1 You qualify as an Authorized User of the Journal to which your institution has a paid electronic subscription if you are a current member of the academic, library, research or equivalent staff of the institution for which a licence has been purchased or a student actively and currently undertaking a course, and you access the Journal through the institution's computer network. If you are a physical visitor to the institution using a public access terminal, you may also be allowed to use the Journal. 3.2 You may (i) access; (ii) search; (iii) download or (iv) view the Journal and make single printed or electronic copies of individual articles for personal use only. Authorized Users may use the Journal by remote access through a modem if thereby your computer becomes (temporarily) part of the institution's network. 3.3 You may not (i) sell; (ii) loan; (iii) lease; (iv) transfer; (v) modify or (vi) reproduce or otherwise use the Journal or any part of it except as is permitted in clause 3.2 above. 3.4 You may not use any paper copies of part or parts of the Journal in coursepacks or other collections for teaching purposes, whether within the institution or not, without seeking further permission from the Consortium. 3.5 You may not make any part of the Journal available for access to others outside the institution within which you are an Authorized User.Acknowledgements
